1) Scope

1.1 These T&C apply to all contracts between farfromlove GmbH (hereinafter “Seller”) and customers regarding the supply of goods from the Seller’s online shop. Deviating terms of the customer are expressly excluded unless agreed in writing.
1.2 These T&C also apply to the purchase of vouchers, unless otherwise specified.
1.3 Consumer: Any natural person entering into a legal transaction for purposes predominantly outside their commercial or independent professional activity.
1.4 Entrepreneur: Any natural or legal person or legal entity acting in the exercise of their commercial or independent professional activity when concluding a legal transaction.


2) Conclusion of Contract and Payment Terms

2.1 Product descriptions in the online shop are non-binding. By placing an order via the online order form, the customer submits a binding offer.
2.2 The contract is concluded when the Seller accepts the offer within five days, either by:

  • Written order confirmation (email or fax),

  • Delivery of the goods, or

  • Request for payment.
    2.3 The contract text is stored by the Seller and transmitted in text form after completion of the order. For registered customer accounts, the data can be accessed there.
    2.4 Payment methods:

  • Prepayment (bank transfer) – due immediately upon conclusion of the contract

  • PayPal – according to PayPal terms of use

  • Amazon Payments – via Amazon Payments Europe

  • SOFORT – via SOFORT GmbH

  • Stripe / Shopify Payments – via Stripe Payments Europe

  • SumUp – via SumUp Limited

  • SEPA direct debit – after mandate submission, possibly with pre-notification

  • Ratepay / secupay – direct debit with successful credit check; payment to service provider with discharging effect

  • Klarna – via Klarna Bank AB, terms at www.farfromlove.com/payments


3) Right of Withdrawal

3.1 Consumers generally have a right of withdrawal.
3.2 Details are provided in the Seller’s withdrawal instruction.
3.3 The right of withdrawal does not apply to consumers residing outside the EU.


4) Prices

4.1 All prices include statutory VAT. Shipping costs are shown separately.
4.2 Additional costs such as customs duties or bank fees may apply for delivery outside the EU.


5) Delivery and Shipping Terms

5.1 Delivery is made to the address provided by the customer.
5.2 If delivery fails due to reasons for which the customer is responsible, the customer bears the resulting costs.
5.3 Transfer of risk:

  • Entrepreneurs: upon handover to carrier/freight forwarder

  • Consumers: generally upon handover to authorized recipient; exceptions if customer arranges transport
    5.4 Seller’s right to withdraw in case of non-availability of goods.
    5.5 Self-collection is not possible.
    5.6 Vouchers are provided by email.


6) Retention of Title

Goods remain the property of the Seller until full payment is received.


7) Warranty (Defects Liability)

7.1 Entrepreneurs: choice of supplementary performance, 1-year warranty on new goods; used goods excluded.
7.2 Consumers: 1-year warranty; for used goods only by express agreement.
7.3 Exceptions: liability for damages, fraudulently concealed defects, construction-related products, digital products.
7.4 Entrepreneurs: statutory recourse claims remain unaffected.
7.5 Merchants: inspection and notification obligations according to §377 HGB.
7.6 Consumers: obvious transport damage must be reported.


8) Liability

8.1 Unlimited liability for intent, gross negligence, injury to life, body, or health, warranty promises, or product liability.
8.2 For negligent breach of essential contractual obligations, liability is limited to typical, foreseeable damages.
8.3 Other liability excluded.
8.4 Rules also apply to vicarious agents and representatives.


9) Redemption of Promotional Vouchers

9.1 Only redeemable in the online shop during the specified period.
9.2 Excluded products may be specified on the voucher.
9.3 No retroactive crediting.
9.4 Only one voucher per order.
9.5 Remaining balance is not refunded.
9.6 Insufficient value → pay difference using other payment methods.
9.7 No cash payment or interest.
9.8 Return of goods → voucher partially expires.
9.9 Transferable; Seller may perform to the holder.


10) Redemption of Gift Vouchers

10.1 Purchasable vouchers redeemable only in the online shop.
10.2 Valid until the end of the third year after purchase; remaining balance credited.
10.3 No retroactive crediting.
10.4 Only one voucher per order.
10.5 Only for goods, not for other vouchers.
10.6 Insufficient value → pay difference using other payment methods.
10.7 No cash payment or interest.
10.8 Transferable; Seller may perform to the holder.


11) Applicable Law

11.1 German law applies, excluding international sales law. Consumer protection laws remain unaffected.
11.2 Choice of law does not apply to consumers outside the EU regarding the right of withdrawal.


12) Jurisdiction

For merchants, legal entities under public law, or special funds: exclusive jurisdiction is the Seller’s registered office.


13) Alternative Dispute Resolution

13.1 EU platform: https://ec.europa.eu/consumers/odr
13.2 No participation in consumer arbitration procedures.
